Welcome to DAMMA. These Terms of Service ("Terms") govern your access to and use of damma.me (the "Site") and any products or services we offer through it. Please read them carefully. By using the Site, creating an account, or placing an order, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, please do not use the Site.
1. Definitions
- "DAMMA", "we", "us", "our" refer to the operator of the Site.
- "You", "your" refer to anyone who accesses the Site, whether as a guest or as a registered customer.
- "Order" means any request to purchase products listed on the Site.
- "Products" means the silicone food storage items and any other goods we sell on the Site.
2. Eligibility
By using the Site, you confirm that:
- You are at least 18 years old, or you are using the Site under the supervision of a parent or legal guardian.
- The information you provide is accurate, complete, and up to date.
- You will use the Site only for lawful, personal, non-commercial purposes, unless we have agreed otherwise in writing.
3. Your Account
You may browse the Site without an account, but creating an account is required to place an order.
- You are responsible for keeping your login credentials confidential and for all activity that takes place under your account.
- You agree to notify us immediately at support@damma.me if you suspect any unauthorised use of your account.
- We may suspend or terminate accounts that violate these Terms, that show signs of fraud, or that we reasonably believe are being used in bad faith.
4. Products and Descriptions
We make every effort to describe and photograph our products as accurately as possible. However:
- Colours may appear differently on different screens, and natural variation in materials may cause minor differences between the product you receive and the photograph.
- Product descriptions, dimensions, and care instructions are provided for informational purposes. They are not part of any binding warranty unless we have explicitly stated so.
- We may, from time to time, correct errors, update descriptions, or change the availability of any product without prior notice.
5. Pricing and Currency
- All prices on the Site are listed in Lebanese Pounds (LBP) and/or US Dollars (USD), as displayed at checkout.
- Prices may change at any time before you place an Order. The price applicable to your Order is the one displayed at the time of confirmation.
- We make every effort to ensure prices are correct. If we discover that a product was listed at an obviously incorrect price (for example, due to a typographical error), we may cancel any Order placed at that price. If your Order is cancelled, we will inform you at the contact details you provided.
6. Orders
- Submitting an Order through the Site is an offer by you to purchase the Products you have selected, subject to these Terms.
- Your Order is not considered accepted until we send you a written confirmation (typically by email).
- We reserve the right to refuse or cancel any Order, including but not limited to: suspected fraud, inability to verify shipping details, stock unavailability, or pricing errors.
- We may, at our discretion, limit the number of items per Order or per customer.
7. Payment
DAMMA currently accepts only Cash on Delivery (COD) within Lebanon.
- Payment is made in cash, in full, to the courier at the time of delivery.
- Please ensure you have the exact amount available, in the currency displayed at checkout.
- We do not handle, store, or have access to any payment card information.
- If we add other payment methods in the future, the corresponding terms will apply at the time of checkout.
8. Delivery
- We currently ship within Lebanon only.
- Delivery times are estimates and may vary depending on your location, the courier's schedule, and external factors beyond our control.
- You are responsible for providing an accurate shipping address and a contact phone number that can be reached by the courier.
- If a courier is unable to reach you after reasonable attempts, your Order may be returned to us. We may then attempt to contact you to arrange a redelivery, which may incur additional shipping fees.
- Risk of loss and title for the Products pass to you upon delivery to your shipping address.
9. Returns and Sales Status
At this time, all sales are considered final. Once an Order is delivered and payment is made, the sale is complete.
We are working on a structured return and refund policy and will publish it on the Site once available. Until then, if you receive an item that is materially defective, damaged in transit, or that does not match your Order, please contact us at support@damma.me within a reasonable time of receiving your delivery, and we will work with you in good faith to resolve the issue.
These Terms will be updated when our return and refund policy is officially announced.
10. Acceptable Use
When using the Site, you agree not to:
- Violate any applicable law or regulation.
- Use the Site to defraud, harass, threaten, or harm any person or entity.
- Submit false, misleading, or malicious information.
- Attempt to gain unauthorised access to our systems, accounts, or data.
- Use any automated tool (bots, scrapers, crawlers) to extract data from the Site, except for legitimate search engine indexing.
- Interfere with the security or integrity of the Site or attempt to bypass any of our protective measures.
- Reverse-engineer, decompile, or copy any portion of the Site or its underlying code, except as permitted by law.
We may suspend or terminate access for any user who violates this section.
11. Intellectual Property
All content on the Site — including logos, brand names, product designs, photography, text, illustrations, and the underlying software — is the property of DAMMA or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may view and use the Site for your personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, publicly display, or create derivative works from any content on the Site without our prior written consent.
12. User-Submitted Content
If you submit content to the Site (for example, a product review, a contact-form message, or a support enquiry):
- You confirm that the content is your own and does not infringe the rights of any third party.
- You grant DAMMA a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content in connection with the Site and our marketing, with appropriate attribution where applicable.
- We reserve the right to moderate, edit, or remove any user-submitted content that we consider inappropriate, off-topic, unlawful, or harmful.
13. Disclaimers
To the maximum extent permitted by law:
- The Site and its contents are provided "as is" and "as available", without warranties of any kind, whether express or implied.
- We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
- Product descriptions, images, and information are provided for general guidance only.
Nothing in these Terms is intended to exclude or limit any rights you may have under mandatory provisions of Lebanese law that cannot be lawfully waived.
14. Limitation of Liability
To the maximum extent permitted by law, DAMMA, its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of the Site or any Products purchased through it.
Where liability cannot be excluded, our total aggregate liability to you in connection with any Order will not exceed the amount you actually paid for that Order.
15. Indemnification
You agree to indemnify and hold harmless DAMMA, its owners, employees, and partners from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of: (a) your use of the Site, (b) your breach of these Terms, or (c) your violation of any law or the rights of any third party.
16. Force Majeure
We will not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure is caused by events beyond our reasonable control, including but not limited to: power outages, internet failures, currency restrictions, customs delays, strikes, civil unrest, governmental actions, natural disasters, or pandemics.
17. Termination
We may suspend or terminate your access to the Site or your account, in whole or in part, at any time and without prior notice, if we reasonably believe that you have violated these Terms or that continued access poses a risk to us, our customers, or our systems.
You may terminate your account at any time by emailing us at support@damma.me. Termination does not affect any rights or obligations that have already accrued.
18. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, our services, or applicable law. When we make a material change, we will update the "Last Updated" date at the top of this page and, where appropriate, notify you by email or by a notice on the Site. Continued use of the Site after a change means you accept the updated Terms.
19. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Lebanon. Any dispute arising out of or in connection with these Terms or your use of the Site will be subject to the exclusive jurisdiction of the competent courts of Beirut, Lebanon.
20. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
21. Entire Agreement
These Terms, together with our Privacy Policy and any other policy referenced on the Site, constitute the entire agreement between you and DAMMA regarding your use of the Site and supersede all prior or contemporaneous communications, whether oral or written, on the same subject.
